Terms and conditions
PLEDGE WALLET TERMS AND CONDITIONS WHEREAS
1. Pledge has developed a product known as the Pledge Wallet, whereby the wallet-holder uses the wallet issued to him or her by Pledge at any ATM/POS terminal, via Mobile APP or USSD within or outside Nigeria for: Cash Withdrawal from his/her account, Funds transfer, Change of PIN, and any other services that may be added in the future by Pledge.
2. The Wallet-holder has requested for and has been given a Pledge Card and Access to Mobile and USSD channels for the above service and Pledge Finance has agreed to provide the above service.
NOW IT IS HEREBY AGREED AS FOLLOWS:
3. Pledge will issue the wallet-holder with a Pledge Card and access to Mobile and USSD channels once the Salary Advance has been approved and activated. I. For any reissuance of same Finance from time to time, you hereby need PIN and / or Passwords to be used in conjunction with the Wallet II. The Pledge Wallet Activation fee is not refundable under any circumstances.
4. PLEDGE WALLET USE
The Pledge Wallet may only be used (a) By the Wallet-holder (b) Strictly in accordance with the terms and conditions as set out in this agreement.
5. SAFEGUARDING THE WALLET AND PIN AND PASSWORDS
I. The Wallet-holder shall exercise all possible care to ensure the safety of the Pledge Wallet in his/her possession. II. The Wallet-holder must not disclose the PIN and / or PASSWORDS to any other party III. Pledge Finance shall not be liable for any loss or damage the Wallet-holder may suffer, arising from the Wallet-holder not exercising all reasonable care, in maintaining the safety of the Pledge Wallet or of the PIN IV. The Wallet-holder must never write the PIN and / or Passwords on the Pledge Card or on anything usually kept with it. V. consequently makes use of the card/PIN, the third party shall be deemed to be the duly authorized agent or
Pledge shall not be held liable against such claims.
6. LOST CARDS
I. Where a card is lost, stolen, mutilated or any other reason liable to misuse, or if the PIN and / or Passwords is disclosed, the Wallet-holder must immediately notify Pledge at 18, Norman Williams, Ikoyi, Lagos. II. Notice given orally to Pledge shall only become effective when in writing and upon receipt of such notice by Pledge. Where notice as required by this section is not given, the Wallet-holder shall be liable in respect of any use of this card. III. The Wallet-holder shall provide Pledge with all the information in the Wallet-holder's possession regarding the loss, theft, or misuse of Pledge Card or the disclosure of the PIN and / or Passwords and shall take all necessary steps as Pledge may require to assist in the recovery of the card. IV. In the event of any loss, theft, misuse, or disclosure suspected, Pledge may provide the police with any information in considers necessary and relevant. In the event of loss. V. The Wallet-holder shall be liable to pay for all transactions carried out on the account and/or losses incurred. VI. Pledge shall not be liable for consequences that may arise as a result of disclosures to any third part arising out of a transaction instruction initiated by the Wallet-holder I. The Wallet-holder shall not hold Pledge liable, accountable or responsible in any way whatsoever for any loss, injury or damage however caused, arising out of the use of the Pledge Card or Mobile APP or USSD access points, and shall indemnify Pledge for any loss suffered and for any suit brought against Pledge by the Wallet-holder or any third party.
7. LIMITATION OF LIABILITY
I. Subject to any statutory limitations, no claim by a Wallet-holder against a third party may be the subject of a claim against Pledge II. The Wallet-holder shall not assign or otherwise dispose of any of his/her right under this agreement.
8. DISCLOSURE OF INFORMATION
I. Pledge may hold and process electronically or any other means information obtained about the Wallet-holder in consequence of this agreement. II. Pledge may disclose information on the Wallet-holder to: (a) Any person (including the police) for purpose of controlling fraud (b) Any relevant party involved in processing Card or Mobile APP or USSD transactions (c) Any party if permitted or compelled to do so by a court of law .
9. VARIATION OF AGREEMENT
Pledge may vary the terms of this agreement at any time with notice to the Wallet-holder
10. REVIEW OF SUBSCRIPTION
I. Pledge may at any time and with notice to the Wallet-holder suspend or cancel the Wallet-holder's right to use the Pledge Wallet entirely or in respect to the Salary Advance or refuse to re-issue, renew or replace the Pledge Wallet without affecting any outstanding obligation the Wallet-holder may have under this agreement. ii. The Pledge Wallet and its access channels remain the property of Pledge at all times, and the Wallet-holder may unsubscribe to the Pledge Wallet by writing to Pledge. However, the agreement will not end until the Wallet-holder has sent back to Pledge Finance all Pledge Wallet related materials in his/her possession and has settled all outstanding obligations under his agreement.
Pledge shall not be liable to the Wallet-holder if Pledge is unable to perform its obligations under this agreement due(directly or indirectly) to the failure of machine, data processing tools and systems, transmission links, industrial disputes, anything outside the control of Pledge or its agents(including staff members or sub-contractors).
